Clinical negligence

We assess how clinical negligence may affect an individual’s career, employment and future earnings, comparing the opportunities that might otherwise have been available with what is now realistically achievable. We also consider rehabilitation, retraining and future support needs.

Clinical negligence cases may involve a major change in a person’s health, functioning and expected working life. The employment questions can range from the loss of an established career to the future prospects of someone who has not yet entered employment.

Our work may include consideration of the career and earnings that might realistically have developed without the injury or condition, alongside the work now likely to be possible. This may involve the employment consequences of acquired disability, brain or spinal injury, restricted mobility, fatigue or other long-term difficulties, together with vocational rehabilitation, retraining and future employment support.

We do not determine questions of medical causation or clinical negligence. We rely on the appropriate medical evidence and consider its employment and vocational implications.
